For example, a blatantly unjust or ineffective law is a legal disaster. A law that produces serious and harmful intentional effects, such as effects opposite to those intended, is another type of legal misfortune. A law so inaccurate and confusing that judges don`t know how to apply it and lawyers don`t know how to advise their clients is another example of a legal disaster that I focus on in this paper. Since this document is a contribution to a symposium on trade disasters, my example is Article 2-209 of the Uniform Commercial Code (UCC), which deals with amendments and waivers to contracts. But my goal is not to explain why 2-209 is a disaster of the third kind – everyone already knows that this is the case. I use the section to illustrate the kind of legislative strategy that can`t help but create a darkening disaster. Sections 2 to 209 illustrate what happens when legislators who boldly try to reform the law cannot bring themselves to carry out their plan or never fully understand the implications of what they are doing.
